Stairway to Devon Web Directory Terms of Use

The Stairway to Devon Web Directory is provided as a resource to residents, businesses and organisations located in Devon, or having regional services for residents, businesses or visitors of the county. 

Membership

You do not need to register as a member to submit your website to this directory, but if you do register before adding listings, you will also be able to edit your listings in future. Members are also welcome to submit news or press releases to our Members' News page.  Please note that as members are able to update their own listings, they are also responsible for ensuring that links in their listings are maintained in working order, and that their content remains suitable for publication and in keeping with our guidelines.

Submitting to Categories

Each website may be submitted to up to 5 categories within the directory, including RSS feeds, E-cards, webcams and blogs.  If you want to submit the specific URL (web page address) for each of these features, you will need to submit them separately, but please ensure that submissions for the website overall do not exceed 5 categories. We reserve the right to move listings to more appropriate categories if necessary.

Subdomains

Subdomain addresses are accepted if they are genuinely separate websites (eg Geocities or Blogspot websites), or if the total number of categories does not exceed 5 for the website as a whole including all subdomain addresses.

Free Listings and Paid Features

Basic listings are free if you link back from your website to our home page, but paid features are also available, including E-Cards, featured images, and banner advertising.  Payment can be made either by secure online payment, handled by Beach Web Design's PayPal payment pages, or by sending a cheque or postal order to this address within 7 days:  Beach Web Design, PO Box 178, Exmouth, Devon, EX8 1WT.  Please specify your membership and listing details when writing to us.  Please make cheques payable to Beach Web Design.

Website Content Policy

Beach Web Design and Stairway to Devon cannot be held responsible for the content of external websites linked from the Stairway to Devon website, or for any consequences of using information, products or services provided on websites linked to Stairway to Devon's website.

We do not accept listings, links, events or adverts for websites containing pornography, violence, gambling, racism or otherwise illegal content, promotion of guns, or promotion of illegal activities. 

We do not publish listings, links, events or adverts for affiliate sites, unless either their WHOIS information or their contact page shows that their main address is in Devon.

To allow for checking of content, we do not publish listings, links, events or adverts for websites in foreign languages unless an English translation is also available.

We do not publish listings, links, events or adverts for online-only pharmacies, foreign based educational, medical or dental services, credit cards or debt related services.

We reserve the right to refuse publication if we consider that any listing or event submitted by a user of the website does not have a strong enough local connection to Devon, though we may make exceptions if we feel the content is particularly suited to the environmental or artistic focus of this website. Where a larger organisation has a specific regional office or service, please use the URL for the regional website or web page for this directory.

We will check all listings for inappropriate content when they are submitted, but we cannot guarantee that either the user-submitted listings or the external websites they link to will remain free of such content. Members are responsible for all content submitted using their usernames and we will not accept liability if inappropriate user submitted content is found.

It is members' own responsibility to ensure they have obtained permission in connection with any copyrights and trademarks for text and images used in their published items on this website, and that their online content is suitable for publication and within our guidelines, and Beach Web Design cannot be held responsible for ensuring this. 

However, if we are informed of content in breach of our guidelines, or if we discover such content later on, the listing and / or feature will be removed and no refund will be offered. 

We will also remove listings if we receive justifiable complaints of targeted personal attacks (ie bullying). 

Any repeated breach of our guidelines will result in the member and all their content being removed from this website, with no refunds.

Directory Editing and Administration

Beach Web Design is the sponsor of the directory and edits and administers information provided within the directory. We reserve the right to modify or exclude any information, in whole or in part, provided by users for inclusion in the online directory.


Privacy Policy

Information provided by registered users to the Stairway to Devon Web Directory will be reserved exclusively for use within, or for management of, the directory. We will never sell, rent or trade our member list, including email addresses and other contact information, to any third-party. However, please be aware that any information provided for publication in the directory web site is inherently available for public viewing, and may be gathered for other uses by third-parties.

This website uses cookies, listed in the visitor's browser, to identify users for each particular login session. Some of our advertisers also use cookies to identify when visitors to their websites were referred from our website.

Some technical and marketing related information is collected, for example operating systems and browsers used, referring sites and search engine keywords which brought visitors to our website. None of the information collected is personally identifiable, and it is used only for planning future technical and marketing developments.

News Emails

From time to time, we may send email to registered users relating to website maintenance, upgrades, new information or offers provided by the directory. Such emails may also include information from local charities or special offers from our advertisers, however, we will not send emails purely for these purposes.  We respect your time and will make every effort to minimize the number of emails you receive from the Stairway to Devon Web Directory (eg we only sent 2 email newsletters in the year 2007-2008!). However, in case you prefer not to receive any email newsletters from Stairway to Devon, an unsubscribe option will be available at the bottom of the newsletter.

Cancellation of Subscription Payments

Subscriptions  can be cancelled directly through PayPal.  If a payment is missed, we will assume that those paid features are no longer required and deactivate them. 

Cancellation of Directory Listings

Please inform us if you want a listing cancelled completely, either by using the contact form on this website or by writing to: Beach Web Design, PO Box 178, Exmouth, Devon, EX8 1WT.  Please specify your membership and listing details when writing to us, as we will email you to confirm that you want the listing cancelled.


Payment Errors and Non-Payment of Subscriptions

If a payment is unsuccessful, or for any reason is not received,  the paid features will be deactivated until payment is received.  We reserve the right to remove listings completely if financial handling fees are incurred as a result of payment errors. We reserve the right to unpublish free listings if the reciprocal link to our website is removed.

Force Majeure

Neither Beach Web Design nor the directory members shall be liable for any delay or failure to perform any of their obligations if the delay or failure results from events or circumstances outside their reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, the act or omission of government, highway authorities or any telecommunications carrier, operator or administration or other competent authority, the act or omission of any Internet Service Provider, or the delay or failure in manufacture, production, or supply by third parties of equipment or services, and the party shall be entitled to a reasonable extension of its obligations after notifying the other party of the nature and extent of such events.

Computer Hacking and Malicious Software

Beach Web Design will take reasonable precautions to protect this website and its contents from computer hacking and viruses. However, neither Beach Web Design nor the directory members shall be liable for any damage, financial loss, other harmful effects or offense caused as a result of malicious attacks on this website, its members or visitors, its name or associated domain names, including but not limited to computer hacking, viruses, email spoofing, domain spoofing, phishing, false representation or impersonation.

Refunds

Members will be entitled to refunds if they cancel their listing on the following grounds: their submittal is within our acceptable content guidelines and has not been published within 21 days of submittal (35 days for featured images).  Refunds for other reasons will be issued at our discretion only.


Termination of Service

We have no plans to terminate our service, but in the event that this became necessary, we would place a notice on the website, give notice to subscribing members to cancel future subscription payments, and refund payments for paid features on the following basis:

• Banner advertising: a percentage of fees paid for the anticipated total services provided would be refunded to reflect the number of impressions displayed as a percentage of the total number of impressions paid for.
• Featured images: a percentage of fees paid for the anticipated total services provided would be refunded to reflect the number of days the image is displayed as a percentage of the total number of days paid for.
• E-cards and paid listings: Purchases of e-cards and paid listings made within 90 days of termination of service will be refunded.

Assignment

Beach Web Design may assign or otherwise transfer this agreement at any time. If this action is taken, Beach Web Design will inform the customer by email, where available, at least one calendar month in advance.
If directory members wish to transfer ownership of their paid listings or subscription billing agreements to somebody else they must obtain written consent from Beach Web Design, either by using the contact form on this website or by writing to: Beach Web Design, PO Box 178, Exmouth, Devon, EX8 1WT.  Please specify your membership and listing details when writing to us.


Severance

If any provision of this Agreement is held invalid, illegal or unenforceable for any reason by any Court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if this Agreement had been agreed with the invalid illegal or unenforceable provision eliminated.

Indemnity

Directory members agree to indemnify and hold Beach Web Design and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Beach Web Design arising out of any breach by the directory member of the terms of this Agreement or other liabilities arising out of or relating to the Website.
